IMPORTANT NOTICE: THESE TERMS CONTAIN A RELEASE OF LIABILITY, WAIVER OF CERTAIN LEGAL RIGHTS, AND A REQUIREMENT TO ARBITRATE DISPUTES ON AN INDIVIDUAL BASIS (NO CLASS ACTIONS).
Definitions:
“Event” means any event, class, workshop, gathering, or ticketed experience offered by or at Casa Campo.
“Venue” means the property, grounds, improvements, parking areas, and adjacent areas used in connection with an Event.
“Released Parties” means Casa Campo Homestead LLC, the owner(s) of the Venue (the “Owner”), and each of their respective members, managers, officers, directors, employees, agents, volunteers, contractors, licensors, affiliates, representatives, successors, and assigns, as well as any Event facilitator(s) or instructor(s) and any Event sponsors and vendors, in each case, to the extent acting in connection with the Event.
1. Acceptance of Terms
By accessing our website or purchasing a ticket/product, you agree to these Terms & Conditions (“Terms”). If you do not agree, please do not use the site or purchase tickets. We may update these Terms at any time; the “Effective Date” above reflects the latest version. By completing a purchase, checking a box, clicking “I agree,” or otherwise indicating assent electronically, you agree that (i) you have read and understand these Terms, (ii) you intend to be legally bound, and (iii) your electronic assent is the legal equivalent of your handwritten signature. These Terms apply to you and, if you purchase a ticket for or bring any other person (including a minor) to an Event, also apply to such person(s) as set forth below.
2. Who May Purchase
You must be 18+ (or 16+ with a parent/guardian purchasing and present) and able to enter a binding contract under Florida law. You represent and warrant that you are at least eighteen (18) years old and have the legal capacity to enter into these Terms. If you purchase for, accompany, or bring any minor or other attendee (each, an “Additional Attendee”), you represent and warrant that you are the parent/legal guardian of such Additional Attendee or otherwise have full legal authority to bind them to these Terms, and you agree to be fully responsible for the acts and omissions of each Additional Attendee. We may require government-issued identification at check-in.
3. Tickets, Pricing & Payment
All prices are shown in USD and may be subject to applicable taxes/fees.
We sell a limited number of tickets. Your purchase is confirmed when you receive a confirmation email.
We accept the payment methods shown at checkout (e.g., card wallets via our processor such as Stripe/Square). Third-party processors may have their own terms and privacy practices.
Tickets are a revocable, non-exclusive license to attend the applicable Event,
subject to these Terms and our on-site rules, capacity limits, safety requirements,
and operational needs.
All sales are final except as expressly stated in Section 5 and Section 6.
You authorize us (and our payment processor) to charge the payment method provided for the total amount of your purchase, including applicable taxes/fees.
Fraudulent or unauthorized purchases are prohibited. We may cancel any order that we reasonably believe involves fraud, misuse, or violation of these Terms.
Chargebacks/Payment Disputes: Before initiating a chargeback or payment dispute, you agree to contact us at casacampohomestead@gmail.com and provide a reasonable opportunity to resolve the issue. You agree that initiating a chargeback in violation of these Terms may result in denial of entry and/or future purchase restrictions, to the extent permitted by law.
4. Discounts & Promo Codes
Any promotion (e.g., “2 o más → $100 c/u”) applies only as displayed at checkout and may be changed or ended at our discretion.
Promo codes are not redeemable for cash, are non-transferable, and may not stack unless explicitly stated.
We may revoke, modify, or refuse any promotion or promo code where we reasonably believe it is being used improperly, fraudulently, or in violation of these Terms.
5. Cancellations, Refunds & Transfers (Event Tickets)
Refunds: Full refund up to 7 days before the event start time. Within the last 7 days, tickets are non-refundable.
Transfers: You may transfer your ticket to another person up to 24 hours before the event by emailing casacampohomestead@gmail.com with your order number and the new attendee’s full name.
No-shows are not eligible for refunds.
Refunds (Ticket Price Only): Full refund of the ticket price paid (excluding processing fees charged by third parties, if any) if requested in writing more than seven (7) days before the Event start time. Within seven (7) days of the Event, tickets are non-refundable.
Processing/Platform Fees: Any third-party processing or platform fees are non- refundable to the maximum extent permitted by the processor/platform’s policies.
Transfers are permitted only once per ticket, must be requested at least twenty-four (24) hours before the Event, and are not complete until confirmed by us in writing.
We may refuse transfers that appear to be for resale, commercial distribution, or circumvention of our policies.
6. Changes, Weather & Force Majeure
The program may be adjusted for weather, safety, facilitator availability, or other operational reasons. If we reschedule for reasons beyond our control, your ticket remains valid for the new date. If we cancel without rescheduling, we will issue a full refund of the ticket price paid. We may change the Event format, content, schedule, location within the Venue, facilitators, or other aspects of the Event at any time for safety, weather, operational, or other reasons. Force Majeure: We are not responsible for delays, changes, or cancellations caused by events beyond our reasonable control, including severe weather, natural disasters, fire, flood, power outages, acts of government, public health emergencies, labor disputes, vendor/facilitator nonperformance, transportation disruptions, or other similar events. If an Event is rescheduled, your ticket will be valid for the rescheduled date (or, at our discretion, you may receive a credit for a future Event). If we cancel an Event and do not reschedule, your sole and exclusive remedy is a refund of the ticket price paid (excluding non-refundable third-party fees, if any).
7. Wellness Content — No Medical Advice
Our events involve gentle breathwork, meditation, and discussion for general wellness. They do not constitute medical advice, diagnosis, or treatment. Consult your physician if you are pregnant, have a health condition, or take medications. Participation is optional—please listen to your body. You acknowledge that participation is voluntary and that you are solely responsible for determining whether you are physically and medically able to participate. We do not provide medical services, and no provider- patient relationship is created.
8. Assumption of Risk; Release; Indemnity
By attending, you acknowledge that outdoor/indoor activities involve inherent risks (e.g., uneven terrain, weather exposure, insect bites, dizziness, reactions to food). You assume all risks associated with attendance and agree to the Event Waiver incorporated here by reference: Event Policies. To the extent permitted by Florida law, you release and hold harmless Casa Campo Homestead LLC, its owners, staff, volunteers, contractors, and the facilitator Carina Pucciarelli from claims or damages arising from your participation, except for gross negligence or willful misconduct. You agree to indemnify us against third-party claims arising from your own conduct at the event.
ASSUMPTION OF RISK: You understand and acknowledge that Events and presence at the Venue involve inherent and other risks, known and unknown, including without limitation: slips, trips, and falls; uneven or wet ground; exposure to heat, sun, rain, wind, or other weather; insects/animals; physical exertion; dizziness, fainting, or aggravation of existing conditions; food-related reactions; interactions with other attendees; use of facilities/equipment; vehicular and parking-area risks; and exposure to communicable diseases. You voluntarily assume all such risks to the fullest extent permitted by law.
RELEASE AND WAIVER: TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, YOU (ON BEHALF OF YOURSELF AND YOUR HEIRS, ESTATE, AND ASSIGNS) HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE THE RELEASED PARTIES FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING ATTORNEYS’ FEES) ARISING OUT OF OR RELATING TO YOUR (OR ANY ADDITIONAL ATTENDEE’S) PURCHASE, ATTENDANCE, PRESENCE AT THE VENUE, OR PARTICIPATION IN THE EVENT, INCLUDING WITHOUT LIMITATION CLAIMS ARISING FROM THE NEGLIGENCE OF ANY RELEASED PARTY, EXCEPT TO THE EXTENT CAUSED BY A RELEASED PARTY’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
INDEMNITY: You agree to defend (with counsel acceptable to us), indemnify, and hold harmless the Released Parties from and against any and all claims, demands, causes of action, damages, losses, liabilities, penalties, fines, costs, and expenses (including attorneys’ fees) arising out of or relating to: (i) your (or any Additional Attendee’s) breach of these Terms, (ii) your (or any Additional Attendee’s) acts or omissions at or in connection with the Event or Venue, or (iii) any claim brought by or on behalf of any Additional Attendee or any third party arising from your (or any Additional Attendee’s) attendance or conduct.
THIRD-PARTY BENEFICIARIES: Owner is an express, intended third-party beneficiary of this Section 8 and Sections 16 and 17, and may enforce them directly.
If our “Event Policies” or any onsite waiver contains additional protections for the Released Parties, you agree that such protections are incorporated herein by reference and shall apply in addition to these Terms.
9. Food & Allergens
Light refreshments may contain or come into contact with nuts, dairy, citrus, gluten, or other allergens. If you have allergies, please inform us after purchase; we cannot guarantee an allergen-free environment. You assume all risks relating to food/beverage consumption and allergen exposure. We make no guarantees regarding ingredients, cross-contamination, or allergen-free conditions.
10. Photography & Media
We may capture general photos for Casa Campo communications. If you prefer not to appear, notify us at check-in and we will mark your preference and do our best to honor it. By attending, you grant the Released Parties a perpetual, worldwide, royalty-free license to use your (and any Additional Attendee’s) name, image, likeness, voice, and/or statements captured during the Event in any media for lawful business purposes (including marketing and social media), without compensation.
Opt-Out: If you prefer not to be intentionally featured, notify us at check-in. While we cannot guarantee you will not appear incidentally in crowd or background images, we will make commercially reasonable efforts to honor opt-out requests for posed/featured content.
You waive any right to inspect or approve any finished product and any claims for invasion of privacy, right of publicity, or similar claims, to the fullest extent permitted by law.
11. Accessibility & House Rules
Tell us in advance about accessibility needs so we can reasonably accommodate. For safety, please walk carefully on natural ground, follow posted instructions, and keep phones on silent. No smoking in event areas.
House Rules / Safety: You agree to comply with all posted rules and staff instructions, including, without limitation, rules regarding parking, noise, smoking/vaping, fires/flames, alcohol, controlled substances, weapons, drones, pets/animals (service animals as required by law), and restricted areas.
Right to Refuse Entry / Remove: We may refuse entry to, or remove from the Venue, any person for safety reasons, capacity limits, intoxication/impairment, disruptive behavior, rule violations, or suspected fraud. In such cases, no refund will be owed.
Property Damage: You are responsible for any damage to the Venue or property caused by you or any Additional Attendee.
12. Prohibited Items; Security; Personal Property
Prohibited Items: Weapons, fireworks, illegal drugs, and any hazardous materials are prohibited. We may prohibit additional items in our discretion for safety.
Security Checks: We may conduct reasonable bag checks or screenings as a condition of entry, to the extent permitted by law.
Personal Property: You are responsible for your personal property. The Released Parties are not responsible for lost, stolen, or damaged items.
13. Intellectual Property
All website and event materials (text, images, logos, graphics, designs) are our intellectual property or used with permission. You may not copy, distribute, or create derivative works without written consent. We reserve all rights not expressly granted. Unauthorized use may result in legal action, including injunctive relief.
14. User Submissions & Feedback
If you voluntarily send testimonials, reviews, or feedback, you grant Casa Campo a non-exclusive, royalty-free license to use them for marketing and operational purposes, consistent with our privacy policy. You represent that your submissions do not infringe any third-party rights and do not contain unlawful, defamatory, or harmful content.
15. Third-Party Services
Our site runs on a third-party platform (e.g., Squarespace) and uses third-party processors (e.g., Stripe/Square/Apple Pay/Google Pay). We are not responsible for those services; their terms and privacy policies apply in addition to these Terms. We disclaim all liability arising from acts or omissions of third-party platforms, processors, carriers, or service providers, to the maximum extent permitted by law.
16. Limitation of Liability
To the fullest extent permitted by law, Casa Campo Homestead LLC will not be liable for indirect, incidental, special, consequential, or punitive damages. Our maximum aggregate liability for claims relating to your ticket or attendance shall not exceed the amount you paid for the ticket(s).
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ANY RELEASED PARTY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS/REVENUE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE MAXIMUM AGGREGATE LIABILITY OF THE RELEASED PARTIES FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE EVENT, VENUE, WEBSITE, OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE APPLICABLE TICKET(S).
Some jurisdictions do not allow certain limitations; these limitations apply to the fullest extent permitted by Florida law.
17. Dispute Resolution; Governing Law
These Terms are governed by the laws of the State of Florida. Any dispute will be resolved in Miami-Dade County, Florida, through binding arbitration under the rules of the American Arbitration Association (each party bears its own fees unless the arbitrator provides otherwise). Either party may pursue a claim in small-claims court in Miami-Dade if eligible. You waive class actions to the fullest extent permitted by law.
Governing Law; Venue: These Terms and any dispute arising hereunder shall be governed by Florida law, except that the Federal Arbitration Act (“FAA”) shall govern the interpretation and enforcement of the arbitration agreement below.
Informal Resolution: Before initiating arbitration, you agree to send a written notice of dispute to casacampohomestead@gmail.com describing the nature and basis of the claim and the relief sought. The parties will attempt in good faith to resolve the dispute for at least thirty (30) days before arbitration is commenced.
Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms, a ticket purchase, an Event, or the Venue shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its applicable consumer rules. The arbitration shall take place in Miami-Dade County, Florida, unless the parties agree otherwise, and may be conducted in person, by video, or based on written submissions as permitted by the AAA rules.
Exceptions: Either party may (i) bring an individual action in small claims court in Miami- Dade County, Florida, if eligible, or (ii) seek temporary or preliminary injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information, pending completion of arbitration.
Class Action Waiver: YOU AND CASA CAMPO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING.
Time Limit: Any claim must be brought within one (1) year after the claim arises, unless a longer period is required by applicable law.
Severability (Arbitration): If the class action waiver is found unenforceable, then the parties agree that the arbitration agreement is unenforceable as to the class/representative portion only, and any such class/representative claims must proceed in a court of competent jurisdiction in Miami-Dade County, Florida; all individual claims shall remain subject to arbitration to the fullest extent permitted by law.
18. Modifications & Severability
We may update these Terms at any time by posting a new Effective Date. If any provision is found invalid, the remaining provisions remain in full force.
Entire Agreement: These Terms (together with any policies incorporated by reference, including Event Policies and Privacy Policy) constitute the entire agreement between you and Casa Campo relating to the subject matter hereof and supersede all prior or contemporaneous understandings.
No Waiver: Our failure to enforce any provision is not a waiver of future enforcement. Headings are for convenience only and do not affect interpretation.
